Has anyone claimed unemployment benefits in EAD in TX state after being laid off? Can you please tell whats the procedure. I do not want to get into the debate of whether UB can be claimed while in AOS state? I just need to know the procedure. Thanks.

dreeft, you could set it up as subcontracting work out though, all the work being funneled through one person and then subcontracted to other members of the "group"

1. Is it mandatory for USCIS to send the NOID/RFE for employer revoked I-140? (if the candidate is invoked AC21)--- There is no guarantee. There has been many cases USCIS denied 485 without sending NOID
2. Can we retain the I-140 after submission of new employer's offer letter and pay stub?

You can simply use the tuition fees deduction on the front of the 1040 return. It will reduce your adjusted gross income. I have been using it for deducting my sons tuition for three years.
Yes, but it can only reduce your taxable income upto $4000. For those who are spending larger amounts towards education in graduate studies lifetime credit in my opinion is better option.

My brother moved jobs early last year. He filed AC21 and got an RFE immediately.
The move was parallel in job function and the pay was good.
They replied to the RFE and then never heard back. In these economic times, USCIS
is scrutinizing every doc that gets filed.

If I go for appointment and they put case under PIMS review as I just got ext approval last months. Will they take passport with them ? if Not can I travel with passport and ask to close case of stamping ?

[I apologize for starting a non-immigration related thread on this personal question.] I am trying to quickly book a US-India Lufthansa flight via Frankfurt for June travel, and the one I am looking at gives me 2-hr stopover (+30mins for boarding) at FRA in between connections, in the same terminal, on the return leg of the trip. My question to those of you who recently traveled via FRA is whether 2-hr is long enough to make the connection. I haven't had such a trip in a while, and not up-to-date with any additional (passport/immigration) verification procedure at this airport. I do know FRA does not require a transit visa.

What will be my options to maintain my immigration status in the following scenario:
AC21 is not filed after joining the new employer (new job since 2 months).

No gap between previous and new current employer.

Please share your experience with purchasing tickets online from sites like makemytrip.com. chepoairines.com etc kinda sites verses travel agents.
I am planning to go from New York to New Delhi after 2-3 months and exploring options. Recently someone I know came from India and paid only 1.5 Lakh rupees for 5 tickets. He could get a good deal because he knew the travel agent.
This shows the huge margins these travel agents and travel insurance agents have. Travel insurance purchased in USA does not even consider pre existing conditions ( their terms and conditions are confusing) and getting them to pay your bills is a big pain. So I can understand why travel agents and travel insurance agents make so much money and can advertise everywhere on TV and websites in USA.
So please share experience and suggest a good website or agent who can give a great deal to me. Do not reply if you are an agent. I am looking for experiences from customers.

Then its advisable to apply in EB3 category and her reasoning was that with her experience she has seen lots of EB2 application in the past few years and very less EB3 apps and hence chances of EB3 being processed earlier than EB2 are quiet high.
I needed some advice on this situation I've found myself in.
I have a PERM application filed with my current employer (EB2, Oct 2007). Like most EB2 apps, mine is under a business necessity audit and we have filed an audit response for it. My lawyers are pretty sure that we will clear the audit. Guessing from , the response may be 2-3 months away.
Now I have a second offer from another company. Everything about the job and company is better than my current, but the legal team at this second company says that they will only file in EB3 (even though the job requirement says Bachelors + 8 yrs). They say that they have other EB2 audits going on and have made it a policy to only do EB3 going forward.
I'm on the 5th year of my H1 (don't ask, had a PD of 2005, caught up in BEC and got laid off last May, refiled Oct 07 with the current employer) and this probably will be the last chance for me to change jobs before I cool my heels and wait for the repercussions of the July Fiasco to be over with.
I can't decide on weather to keep my existing EB2 job or take the new offer and step down to EB3.
Please help!

I have my I140 approved through a american company and my h1b is getting expired in june 09.
According to above wordings, I can get a visa to live and work indefinitely,based on my approved I140. I have never heard about it.
